I agree that the 3 points you make a valid and apply anytime a unit is
attempting to ralley at the beginning of their movement phase. The
arguement arises when you look at fine print wording of the various
rules. That's where the hair splitting comes.

Marines don't auto-ralley on the beginning of their movement. It
states that they ralley at the end of their fall-back. Because of
this, they are almost always more than 6" away (the premise being that
the marines ralley prior to the pursuing sweep). This is one of the
loopholes that seems to be exploited most in justifying the rule in
question.

I don't necessarily agree with this arguement, but it is the only one
that I have heard that supports the 'official' policy of marines
always ralley.

As a side note, as I understand it, it is possible to chase marines
off a board. Marines always ralley (get to ignore the 50% rule), or
at the end of their fall back. So, when marines break and flee off
the board, they auto-ralley on the edge. If they break again, they
flee off. Of course this may be a 'house rule' that has been repeated
so much that nobody remembers the source.

But the wording of ATSKNF says NOTHING about being able to ignore the
requirements for squad coherency or no enemies within 6". It doesn't
need a White Dwarf Chapter Approved ruling because this is how the
rule was written in the codex and should have been played since day
one.
