FYI, in the latest Inquistor's report by GWUK, they had the following blurb for a computer program to create Space Marine armies that they are selling.

Thanks for flagging this to my attention. I've been wondering when this
would finally come out and have been unable to find out any info about it
until now.

I've ordered my copy and I'll see what GW has put together. My initial
reaction isn't very positive regarding their price/value target, since they
are charging only a little less than AB for the Space Marine Codex alone.

If anyone else picks up a copy of this, I'd love to hear what your thoughts
are on it. Send them to me directly at rob@wolflair.com (or post them to
the list if you feel it's important to do so).

My question to you Rob is do you have the name Army Builder patented or
copyrighted because I do believe that they are calling their version the
same thing. If not then copyrights are usually a use it or lose it deal.

Well Rob's product is called "Army Builder" and games workshop's
product is called "Space Marine Interactive Army Builder". While not
exactly the same title I can how this could cause some "confusion"
issues.
Hopefully the product itself is different enough that GW does gain
customers from the great reputation and product that Rob has put out.

The only protection on a name is a trademark. I'm investigating how to
handle this situation. While I knew that GW was coming out with their own
product, I certainly did not expect them to trade on the reputation
established by AB. They are definitely opening themselves up for potential
legal remedy, although they may also be expecting I won't have the
financial resources to contest them. Things could get interesting here, and
I would appreciate it if everyone did not speculate on this matter on the
forum any further. The moment that the potential for lawyers comes into
play, nothing can be commented on publicly until things become a matter of
public record. So I won't be able to say anything further for awhile.

Rest assured that I'll let everyone know as soon as there is anything
concrete that I can publicy state.

Thanks for everyone's continued support, and please make sure that anyone
confusing the two products has the differences clarified for them. :-)

If you need it, I have an Intellectual Properties/Patent&Tradmark Lawyer and
Barrister lockated multinationally with offices in New York City and London.
I spoke with her this morning and she's reviewing the situation in regards
to the legal ramifications in both countries. She _has not_ taken the case,
but will be offering the work on a pro-bono basis (read, free of charge.)
She once was an avid gamer and has a very good track record within the
community.

They don't seem to be using the same name to identify the product so much
as using it as a natural descriptor for their product. What does it do?
It's an army builder!
AFAIK, copyrights are automagic whenever a new work is produced. Even if
Rob doesn't say I can't take his software and put my name on it, I can't.
Of course, defending that is the hard part.
Still, I doubt this will be a big problem, especially since as Rob noted,
they're charging only a little less for a far more limited product.
Besides, they're the Man. Worse costumer support, too.

You must be joking, GW is calling their program "Space Marine
Interactive Armybuilder?" With all the creativity available to GW that's the
best they could do!What a slap in the face for all of us, what a joke. They
should be liable to suffer some type of penalty for ripping off someone
elses idea, but I doubt they will suffer at all. It is more likely that GW
was very careful and legally has a leg to stand on in court.I have not seen
the product yet, so I am unsure as to how close it is to the original" Army
Builder." But judging from the name itself ,I fear the worst.

I've seen and used the GW Army builder, apart from the fact it's incredibly
limited, all it is is some fancy ass graphics, it's a pain in the ass to
use, and no where near as user friendly as the real army builder.
