Tau combat patrol

I'm new to AB 3.1 but have found a small problem with the combat patrol rules. AB consantly says I'm lacking a commander, but an ethereal is not counted, neither is a normal crisis suit even with shas'vre upgrade and the shas'el & Shas'o are illegal due to their high wound count.
Any sollution that I'm missing ?
