Kor'Sarro Khan Error?

When I add The Khan to my list I am always getting a validation error as if some how the requirements for Beginning iPhone 3 Development White Scars Army is not being fulfilled. Obviously all characters can be played as anything you wish so I should have no required tie to a White Scars list. I think this list existed in some for in the past though. Is this a carry over that should be ignored? I have searched everything and it appears I am doing everything correctly for the army.

Please help or advise. Has anyone else seen this with the new AB version and the Khan in the SM list?
